Accident

Definition - What does Accident mean?

An accident is any event which is unexpected and unintentional which can result in injury or death. If you have been injured from the accidental actions of another person you may be eligible to receive compensation for your injuries. To win a personal injury case, however, you will need to prove the accidental actions of another person were negligent or careless, and it was these actions which directly caused your injury.

Determining Legal Liability

Many accidents happen because another person was careless. To prove negligence, however, you do not have to prove that they intended to injure you, only that their actions were a breach of duty owed to you. Breach can be proven if there is evidence that their actions differed from the actions of others in a similar situation.

The most common accidents which can cause personal injury include car accidents, trucking accidents, dog bites, premise liability cases, and medical malpractice cases. In some accidents it will be easy to determine if someone was negligent towards you. For instance, if another driver injures you after they have run a red light there will be evidence that their careless or negligent driving actions were not only illegal, but they also caused your injury.

What if I contributed to my own accident?

If you are partially responsible for your own injuries following an accident some states will reduce your compensation to the extent in which your own carelessness was responsible for the accident. This is called comparative negligence law. Some states will completely eliminate your right to compensation if your actions contributed in any way to the accident.

After an accident it's important to seek proper medical care. If your injuries are serious and they are the result of another person's negligent actions, talk to a lawyer immediately and find out how much money you will need to compensate you for your loss.
